Terms and Conditions

Welcome to Property Kare. These Terms and Conditions (“Terms”) govern your access to and use of the Property Kare mobile application and website located at https://property-kare.ca/ (collectively, the “Platform”), operated by Property Kare Inc. (“Property Kare”, “we”, “us”, or “our”).

By creating an account, downloading the app, or using the Platform in any way, you agree to be bound by these Terms. If you do not agree, please do not use the Platform. These Terms apply to all users, including homeowners (“Users”) and tradespeople or contractors (“Service Providers”).

1. Definitions

In these Terms:

• “Platform” means the Property Kare mobile application (iOS and Android) and website (https://property-kare.ca/).

• “User” means a homeowner, property owner, or tenant who registers on the Platform to submit maintenance requests and hire Service Providers.

• “Service Provider” means a trade professional (electrician, plumber, HVAC technician, handyman, etc.) who registers on the Platform to offer property maintenance services.

• “Subscription Plan” means a recurring paid plan chosen by a User or Service Provider that unlocks specific features of the Platform.

• “Services” means the property maintenance and repair services offered by Service Providers through the Platform.

• “Content” means any information, text, photos, or materials submitted to or displayed on the Platform.

 

2. Eligibility and Account Registration

To use the Platform, you must:

• Be at least 18 years of age.

• Be legally capable of entering into a binding contract under applicable Canadian law.

• Provide accurate, current, and complete registration information.

• Keep your account credentials secure and not share your password with others.

You are responsible for all activity that occurs under your account. If you suspect unauthorized use of your account, you must notify us immediately at support@property-kare.ca.

Property Kare reserves the right to refuse registration, suspend, or terminate any account at our sole discretion.

 

3. User Accounts

3.1 Registering as a User (Homeowner)

As a User, you may:

• Create a property profile and list one or more properties.

• Submit maintenance requests specifying the type of service required (e.g., plumbing, electrical, landscaping).

• Browse and connect with vetted Service Providers through the Platform marketplace.

• Track task history, receive maintenance reminders, and view property insights.

• Communicate with Service Providers via in-app messaging.

You are responsible for the accuracy of all property information you provide and for ensuring that you have the legal authority to authorize Services at the property address listed.

 

3.2 Registering as a Service Provider

As a Service Provider, you may:

• Create a professional profile listing your trade(s), service area, certifications, and rates.

• Receive and respond to service requests from Users.

• Accept bookings and communicate with Users through the Platform.

• Build a marketplace reputation through User reviews and ratings.

By registering as a Service Provider, you represent and warrant that:

• You hold all required licences, certifications, and insurance required by applicable Canadian federal and provincial/territorial law to perform the services you offer.

• All information provided in your profile is accurate and not misleading.

• You will perform all accepted Services in a professional, workmanlike manner in compliance with applicable safety codes and standards.

Property Kare may, but is not obligated to, conduct background checks or verify credentials. Listing on the Platform does not constitute an endorsement of any Service Provider.

 

4. Subscription Plans

4.1 Subscription Tiers

Property Kare offers subscription plans for both Users and Service Providers. Plan details, pricing, and features are described in the Platform. By subscribing, you agree to pay the applicable fees on a recurring basis as specified at the time of purchase.

4.2 Billing and Payment

Subscription fees are billed in advance on a monthly or annual basis, as selected. All fees are in Canadian Dollars (CAD) unless otherwise stated. Payments are processed through our third-party payment processor. By subscribing, you authorize Property Kare to charge your selected payment method on a recurring basis until you cancel.

4.3 Free Trials

Property Kare may offer free trial periods for certain subscription plans. At the end of the free trial, your subscription will automatically convert to a paid plan unless you cancel before the trial period ends.

4.4 Cancellation

You may cancel your subscription at any time through your account settings or by contacting support@property-kare.ca. Cancellation will take effect at the end of the current billing period. You will retain access to paid features until the end of the paid period. We do not provide prorated refunds for unused portions of a billing cycle, except as required by applicable Canadian consumer protection law.

4.5 Refunds

All subscription fees are non-refundable except as required by applicable law (including the Consumer Protection Act, 2002 (Ontario) or equivalent provincial legislation). Requests for refunds due to technical issues will be reviewed on a case-by-case basis. Please contact support@property-kare.ca.

4.6 Price Changes

Property Kare reserves the right to change subscription pricing. We will provide at least 30 days’ written notice before any price change takes effect. Your continued use of a paid subscription after the notice period constitutes your acceptance of the new pricing.

 

5. Platform Use and Acceptable Conduct

5.1 Permitted Use

You agree to use the Platform only for lawful purposes and in accordance with these Terms. You may not:

• Post false, misleading, or fraudulent content, reviews, or service listings.

• Use the Platform to harass, threaten, or harm other users.

• Circumvent the Platform to arrange off-platform payments or engage Service Providers sourced through the Platform outside of Property Kare (“fee avoidance”).

• Scrape, copy, or reproduce Platform content without written permission.

• Use automated tools, bots, or scripts to access or interact with the Platform.

• Upload or transmit malware, viruses, or any malicious code.

• Attempt to gain unauthorized access to any account, server, or network connected to the Platform.

5.2 Reviews and Ratings

Users may submit reviews and ratings for Service Providers after a completed service. Reviews must be honest, accurate, and based on your genuine experience. Property Kare reserves the right to remove reviews that violate these Terms, contain hate speech, defamatory content, or are otherwise inappropriate.

5.3 User-Generated Content

By submitting content to the Platform (including photos, descriptions, and messages), you grant Property Kare a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display such content for the purpose of operating and promoting the Platform. You represent that you own or have the necessary rights to submit such content.

 

6. Property Kare’s Role and Limitations

Property Kare is a technology platform that connects Users with Service Providers. We are not a party to any agreement between Users and Service Providers, and we do not employ, supervise, or control Service Providers. Property Kare does not guarantee:

• The quality, safety, timeliness, or legality of any Services provided by Service Providers.

• That Service Providers hold valid licences or insurance (though we encourage verification).

• That Service Requests will be fulfilled or that suitable Service Providers will be available in all areas.

Any contract for Services is solely between the User and the Service Provider. Disputes regarding the quality or completion of Services must be resolved directly between the parties, though Property Kare may, at its discretion, provide mediation assistance.

 

7. Payments Between Users and Service Providers

Payment terms for individual Services (labour costs, materials, project fees) are agreed upon directly between the User and the Service Provider outside of Property Kare’s subscription billing. Property Kare is not responsible for disputes, non-payment, or billing errors related to the direct engagement between Users and Service Providers. Any financial transactions facilitated through the Platform are subject to our payment processor’s terms.

 

8. Intellectual Property

All content, trademarks, logos, software, and intellectual property on the Platform are owned by or licenced to Property Kare Inc. You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for personal or business purposes as permitted by these Terms. You may not reproduce, distribute, modify, or create derivative works of our intellectual property without prior written consent.

 

9. Privacy

Your use of the Platform is also governed by our Privacy Policy, available at https://property-kare.ca/. By using the Platform, you consent to our collection and use of your personal information as described in the Privacy Policy. Our data practices comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy laws.

 

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE CANADIAN LAW, PROPERTY KARE DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

We do not warrant that the Platform will be available at all times, free from errors, viruses, or other harmful components, or that defects will be corrected.

 

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PROPERTY KARE INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM OR SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, REVENUE, PROFITS, OR PROPERTY DAMAGE.

Our total liability for any claim arising out of or relating to these Terms or your use of the Platform shall not exceed the greater of (a) the total subscription fees paid by you to Property Kare in the 12 months preceding the claim, or (b) one hundred Canadian dollars (CAD $100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages; in such cases, the above limitations apply to the fullest extent permitted by law.

 

12. Indemnification

You agree to indemnify, defend, and hold harmless Property Kare Inc. and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, judgments, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) any Services you provide or receive through the Platform; or (e) any content you submit to the Platform.

 

13. Termination

Property Kare may suspend or terminate your account and access to the Platform at any time, with or without cause or notice, including for violation of these Terms. You may also delete your account at any time through the Platform settings.

Upon termination: (a) your right to access the Platform ceases immediately; (b) any outstanding subscription fees become due; (c) these Terms continue to apply to the extent necessary to give effect to their terms (including sections on intellectual property, disclaimers, limitation of liability, and indemnification).

 

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising out of or related to these Terms or the Platform shall first be attempted to be resolved through good faith negotiation. If not resolved within 30 days, disputes shall be submitted to binding arbitration in accordance with the Arbitration Act, 1991 (Ontario), conducted in English in Toronto, Ontario, unless otherwise agreed by the parties. Nothing in this clause prevents either party from seeking urgent injunctive or equitable relief from a court of competent jurisdiction.

Notwithstanding the foregoing, if you are a consumer located in Quebec, the consumer protection laws of Quebec may provide additional rights, and mandatory arbitration may not apply.

 

15. Changes to These Terms

Property Kare reserves the right to update or modify these Terms at any time. We will notify you of material changes by posting the updated Terms on the Platform and updating the Effective Date. For significant changes, we may also notify you by email or in-app notification. Your continued use of the Platform after the effective date of changes constitutes your acceptance of the revised Terms.

 

16. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.

 

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Property Kare regarding your use of the Platform, and supersede all prior agreements, representations, and understandings.
